Terms of service

« Publisher » : the entity Meltdown, which publishes the Services. Its identification is set out in the legal notice.

« Services » : all platforms published under the name Marsha, including the site marsha.app, the dashboard dash.marsha.app, the archives at archives.marsha.app, the documentation at docs.marsha.app, the Discord bot, the Twitch bot, and the public profiles, together with any other service published under that name. The status page at status.marsha.app is operated by Better Stack.

« User » : any person who accesses or uses the Services, whether or not that person holds an account.

« Public profile » : the page published at a path such as /@username, the content of which is hosted as part of the Services.

« Personal data » : any information relating to an identified or identifiable natural person, within the meaning of Article 4 of Regulation (EU) 2016/679.

The Terms define how the Services may be accessed and the duties of each party. If a general description on the Services contradicts the Terms, the Terms prevail.

The Services provide moderation and community-management tools on Discord and on Twitch, a configuration dashboard, archives, documentation, and the public presentation of the service. The status page is operated by Better Stack.

Access to the Services constitutes full acceptance of the Terms. A User who does not accept the Terms shall not use the Services.

The Publisher may amend the Terms. The version in force is the version published on marsha.app and dated at the head of these Terms. Use of the Services after an amendment takes effect constitutes acceptance of that amendment. The User is invited to read the Terms on each visit.

The Services include, in particular:

the site marsha.app, which presents the service, its functions, and the means of contact;

the Discord bot, offered to the User for moderation and organisation of that User's server, and the Twitch bot;

the dashboard, available at dash.marsha.app, from which the User adds a server and configures the bot;

the archives, available at archives.marsha.app;

the documentation, available at docs.marsha.app;

the status page, available at status.marsha.app, is operated by Better Stack. The Publisher is not its publisher. Better Stack's own terms apply to that page.

the Public profiles.

The Services are ordinarily available at all times. The Publisher may interrupt access for maintenance, an update, or a security constraint. The Publisher informs the User beforehand where that notice is reasonably possible.

The Publisher owes a duty of means as to availability. The Publisher does not warrant uninterrupted availability.

The User accesses the Services with recent equipment, free of malware, and with an up-to-date browser.

The User shall not use the Services for an unlawful purpose, shall not impair their operation, and shall not connect a Discord server or a Twitch channel in respect of which the User lacks the necessary rights.

The User remains solely responsible for the settings applied to that User's community, for the content the User publishes, including on a Public profile, and for the files, images, and links the User uploads. This includes evidence attached to an infraction, files attached to a report, a note, or a reminder, and archives the User creates.

The Publisher owns the intellectual-property rights, or holds the rights of use, in the elements it creates for the Services, including the texts, images, graphics, logo, sounds, and software.

Icons that are public, or that are supplied by a third party, are not the property of the Publisher.

Content supplied by Users, and content taken from Discord, is not the property of the Publisher either. This includes messages kept by the censors, infraction reasons, images and files attached as evidence, archives, reports, notes, reminders, and Public profiles.

Any reproduction, representation, adaptation, or exploitation, not authorised by the Publisher, of an element the Publisher owns may constitute infringement, and may be pursued under Articles L. 335-2 and following of the French Intellectual Property Code.

The Publisher is not liable for indirect loss, including loss of opportunity, custom, data, or revenue, arising from use of the Services.

The Publisher is not liable for material damage to the User's equipment where that damage results from equipment that does not meet Article 6, from an incompatibility, or from a failure attributable to that equipment.

These provisions do not limit liability that the law forbids a party to exclude, in particular in the case of gross fault, fraud, or personal injury.

Personal-data processing is governed by Regulation (EU) 2016/679 of 27 April 2016 and by French Act No. 78-17 of 6 January 1978, as amended. It is described in the privacy policy.

Trackers are described in the cookie policy. The Publisher collects personal data only for the needs of the Services.

The Services may point to third-party sites.

Links placed by the Publisher, including on the site and in the documentation, are mere links. The Publisher does not control the sites they open and accepts no liability for them.

Other links appear in content the Publisher does not choose. They are the links present in a message kept by a censor, in the reason or the evidence of an infraction, in an archive, a report, a note, a reminder, or a Public profile. The Publisher does not set those links. It does not authorise them, does not control the sites they open, and accepts no liability for them.

The Publisher hosts Public profiles and archives made available to the public. It also stores, at the Users' request, files, images, and text, including infraction evidence, reports, notes, reminders, and messages kept by the censors. The Publisher is not the author of that content and accepts no liability for it, subject to this Article.

Any person may notify the Publisher of illegal content, under Article 6, I, 5, of French Act No. 2004-575 of 21 June 2004 and, where it applies, under Article 16 of Regulation (EU) 2022/2065.

The notice is sent to [email protected]. It states the exact address of the Public profile or of the archive, or the identifier of the infraction, of the report, or of the kept message, a description of the content, the facts that make it illegal, and a means of reaching the person who gives the notice.

An incomplete notice may not allow the Publisher to act. A notice given in bad faith may engage the liability of its author.

The Publisher may suspend the access of a User who breaches the Terms, after informing that User where the circumstances allow.

Any notice required by these Terms is sent to [email protected]. An exchange on the Publisher's Discord server does not replace that notice.

The Terms are governed by French law.

Subject to mandatory rules of jurisdiction, including those that protect a consumer, any dispute relating to the Terms or the Services is submitted to the courts of Paris.
